- Goods — clothing, accessories, music media and other goods presented on the Website.
- Order — a request placed by the Buyer to purchase the selected Goods.
2. General provisions and conclusion of the contract
- This document and the information about the Goods and the terms of their sale constitute a public offer within the meaning of Articles 435 and 437 of the Civil Code of the Russian Federation.
- By placing an Order and performing the action by which the Website interface confirms consent to this offer, the Buyer accepts its terms. The retail sale contract is deemed concluded in the manner provided by law after the Seller confirms the Order and/or issues a cash receipt or other document confirming payment.
- Registering an account is not mandatory if the Website allows an Order to be placed without registration.
- Acceptance of the offer is not consent to receive advertising and does not replace separate consent to the processing of personal data where such consent is required by law.
- The Seller may update the offer. An Order already placed is governed by the version in force at the time it was placed, unless later changes improve the Buyer's position.
3. Goods, price and placing an Order
- The main characteristics, composition, available sizes, price and other information about the Goods are given on the product page. The Buyer must read them before placing an Order.
- Photographs show the appearance of the Goods, but shades may differ due to screen settings. Such differences do not in themselves constitute a defect if the Goods match the description and mandatory requirements.
- The Buyer is responsible for the accuracy of the contact details and delivery address. Corrections can be sent to support@dazeraw.com before the Order is shipped.
- If after the Order is placed it turns out that the Goods are unavailable or the price was shown as a result of an obvious technical error, the Seller will contact the Buyer to agree on a replacement, adjustment or cancellation. Payment received for cancelled Goods is refunded by the same method it was made, unless the parties agree otherwise.
4. Payment
- The price, settlement currency, delivery cost and total amount are shown on the checkout page before payment.
- Available payment methods are determined by the Website interface and payment partners. The Order is processed after full payment, unless the Website expressly offers another option.
- For payments covered by Federal Law No. 54-FZ, an electronic cash receipt is sent to the e-mail address or phone number provided by the Buyer.
- For international payments, the bank or payment service may apply its own exchange rate and fees. The Seller does not determine their amount.
5. Delivery
- Delivery methods, costs and estimated delivery times are shown at checkout and further described on the "Information" page.
- The Order is handed over to the Buyer, to the Recipient named by the Buyer, or to another person entitled to receive the parcel under the carrier's rules.
- The risk of accidental loss of or damage to the Goods passes to the Buyer when the Goods are handed over to the Buyer or the Recipient. Until then, the risk is borne by the Seller, unless otherwise established by mandatory provisions of law.
- On receipt, it is recommended to check the packaging, quantity and appearance of the Goods. If the parcel is damaged, ask the carrier to draw up a report and notify the Seller. The absence of such a report does not in itself terminate the Buyer's rights provided by law.
- For international delivery, the Buyer independently complies with the requirements of the destination country and pays import duties, taxes and fees, if applicable.
6. Withdrawal, exchange and return
- The Buyer may withdraw from the purchase of the Goods at any time before they are handed over.
- After receiving Goods of proper quality, DAZE voluntarily provides 14 calendar days for a return, unless otherwise provided by law. This term extends the minimum period established for distance selling by Article 26.1 of the Russian Consumer Protection Law.
- Goods of proper quality may be returned if their original appearance, consumer properties, factory labels and completeness are preserved. The absence of a purchase document does not deprive the Buyer of the right to refer to other evidence of purchasing the Goods from the Seller.
- The Buyer may not withdraw from Goods of proper quality with individually defined properties if such Goods can be used only by the Buyer purchasing them. Other restrictions apply only in cases expressly provided by law.
- To arrange a return or exchange, write to support@dazeraw.com and state the Order number. The Buyer may return the Goods by any method of their choice that allows the Seller to receive and inspect the Goods, including via a carrier or postal service. On request, the Seller provides the return address and available shipping options.
- When returning Goods of proper quality, the Buyer bears the cost of return shipping and the risk of accidental loss of or damage to the Goods in transit. Only the Seller's costs of delivering the returned Goods, as provided by law, may be deducted from the refund.
- Money is refunded by the same method used for payment, unless the parties agree otherwise, no later than 10 days from the date the relevant request is made.
- If a defect is found in the Goods, the Buyer may make the claims provided for by Article 18 of the Russian Consumer Protection Law within the time limits established by law. A claim for a refund of the amount paid is satisfied within the period established by Article 22 of that Law. The necessary confirmed costs of returning Goods of improper quality are borne by the Seller.
7. Liability and dispute resolution
- The parties are liable for breach of obligations in accordance with the laws of the Russian Federation. The terms of the offer do not limit consumer rights that cannot be limited by contract.
- The Seller is not liable for defects arising from the Buyer's breach of the rules of use, storage or care, from the actions of third parties, or from force majeure.
- A claim may be sent by e-mail and to the Seller's postal address. If a dispute cannot be settled through negotiation, it is resolved in court in accordance with the jurisdiction rules established by law; the consumer's right to choose a court as provided by law is not limited.
- The relations of the parties are governed by the law of the Russian Federation, taking into account the mandatory rules of the Buyer's country of residence where such rules apply.
